Hospital & Long Term Care Defense

Health care providers and the organizations that employ them turn to KCF for help with the full spectrum of their operating, regulatory, administrative, and dispute resolution needs. Because of our tenure representing healthcare providers – general care and acute care hospitals and health systems, nursing homes and long-term care facilities, physician organizations and clinics – our team offers not only depth and expertise in addressing defense issues, but also in counseling health and hospital entities on risk and litigation avoidance.

We possess an in-depth understanding of the healthcare industry, the unique operational issues facing providers, and the regulatory, litigation and insurance climates in which our clients operate.  We have an experienced MD/JD as an of counsel to analyze complex medical issues and two shareholders who are RN/JD's with acute care experience. With this breadth of knowledge, we help our clients establish effective risk management programs designed to minimize and alleviate the risks, costs, distractions, and dangers inherent in litigation.

We regularly defend health care providers and provider organizations against claims alleging malpractice, wrongful death, and patient abuse. We represent hospitals and large hospital systems, long-term care providers, physicians, nurses, physician assistants, physician organizations and other health care providers in trial and appellate proceedings arising out of allegations of medical negligence.

The firm has defended dozens of long-term care cases, including the defense of both nursing homes and assisted living facilities. In defending these cases, we have developed an understanding of the unique legal and factual issues which are often presented in long term care litigation. Cases involving standard of care requirements, lawsuits with nursing homes, assisted living facilities, or health care providers are unique because they present concerns that can have a serious impact on community perceptions of health care facilities and providers.
