Construction

Construction defect litigation is a rapidly changing area of law, which presents unique challenges for clients and insurance carriers. Legislative and judicial efforts to limit and control the recent explosion of cases in this area have met with limited success. Insurance carriers and private clients need creative and aggressive approaches to these cases to avoid unnecessary attorneys’ fees and costs where the client or insured has little or no liability, yet is involved in a case which is set for a ten to thirty day jury trial. Prompt investigation and early motions to dismiss or for summary judgment are often needed to force the plaintiff, developer, or general contractor to release an innocent subcontractor or material supplier in the litigation.

We represent owners, contractors, architects and engineers in all types of construction related cases on both private and public projects. We have handled cases on some of the largest projects in this region, including successful representation of numerous clients in litigation arising from the construction of the Denver International Airport (at the time the largest project in North America).

We also understand the difficult insurance coverage issues inherent in large construction defect litigation. Issues on the duty to defend and indemnify under differing additional insured endorsements, evolving theories on how defense and indemnification dollars are to be shared among numerous carriers and use of separate defense counsel are just a few of the key issues facing carriers and clients.
